Hemp vs. Marijuana: How Do They Compare?
18th Jan 2023
When it comes to purchasing hemp products online, what makes marijuana illegal but hemp legal? Lots of people are unclear about the differences between these two closely related plants. After all, they’re technically the same plant, but the effects of marijuana and hemp differ greatly. The Federal Schedule 1 restricted substance, marijuana, is handled quite differently than hemp when it comes to the legality of online sales.
That’s why it’s important for us to unpack hemp vs. marijuana. Hemp Generation’s dedication to long-term wellness and education in the hemp industry means we want our customers to have as much knowledge as possible before they make their purchases. That way they can make informed decisions everyone feels good about.
Legal Classifications of Hemp Vs. Marijuana
In the legal sense, marijuana and hemp have different classifications. Depending on where in the US (or even the world) you are located, these classifications may impact the legality of the substance. This is primarily related to the psychoactive components marijuana offers. The Farm Bill of 2018 breaks this down further.
The Farm Bill Of 2018
Prior to the passing of the 2018 Farm Bill, the United States Federal Government had strong regulations and a heavy hand in preventing the sale of most hemp products. Farmers had to send in an application in order to cultivate the hemp plant. They were then subject to taxation, monitoring, and inspection. The 2018 Farm Bill’s release was instrumental in opening up hemp cultivation within the majority of the U.S. The bill enabled farmers to grow hemp on their land legally so long as the hemp they cultivate contains less than 0.3% Delta 9 THC (measured by weight). As a byproduct of this bill, CBD manufacturers were also able to enjoy these loosened reins.
The Science Behind Hemp Vs. Marijuana
Scientifically speaking, hemp and marijuana are one in the same. Without getting too deep in the weeds, we’re going to look at the chemical composition of marijuana versus hemp. The main differentiator between the two is their chemical composition.
Hemp and marijuana are two different names for cannabis, meaning they are of the same species. The difference is the amount of THC that is within each of them. This is measured by dry weight. Cannabis products that contain less than 0.3% can be classified as hemp, whereas those that contain more than 0.3% are classified as marijuana for its “high” inducing effects.
Note: Before purchasing and/or using any hemp or CBD product, it is highly advised to always check with the laws in your state.
