When measured by their dry weight, however, THCa flower’s levels do not exceed 0.3% of D9 THC. That means that on its own, THCa flower does not yield intoxicating, psychotropic effects. Notice that we said on its own… once it undergoes the process of decarboxylation, however, things change.

The Legality of the THCa Flower

The 2018 Farm Bill was instrumental in the USDA’s regulation of marijuana vs. hemp. As per the bill, all Delta 9 THC products must contain less than 0.3% of THC in their original state in order to be sold legally. Because THCa flower does not exceed this, certain states such as North Carolina are permitted to sell THCa legally. Users still get the same effects that they would from smoking THC when they smoke THCa, but because of its cultivation methods, THCa flower can be grown and sold legally without repercussions. The way the hemp is harvested does not exceed the 0.3% THC content, meaning it is not controlled under federal law.
